1. The contract between us
We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an email to you at the email address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.

The Consumer Protection (Distance Selling) Regulations 2000 require us to provide certain pre-contractual information to you the consumer which includes a customers rights of cancellation. This will be provided in a durable format, e.g. e mail or letter. If in the unlikely event that you cannot find the details of our cancellations procedure or have lost it and still wish to proceed under these terms, we will happily email or send you a written copy upon request.

2. Our right to refuse your order
2.1 We reserve the right to refuse to accept your order for any reason including, without limitation and whether or not payment has been received by us, if:
2.1.1 We have insufficient stock to deliver the goods you have ordered;
2.1.2 We do not deliver to your area; or
2.1.3 One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
2.2 If we do refuse your order we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order, usually within 24 hours. We will not be obliged to offer any additional compensation for disappointment suffered.

3. Price
3.1 The prices payable for goods that you order are as set out in our website.
3.2 You will not be required to pay extra for delivery(unless outside the UK). Our delivery charges are set out in our website and are FREE to the UK and £19.99 everywhere else in the world.
3.3 All orders are processed in GBP at the prices displayed at time of order.

4.1 Returns Policy

The Sale of Goods Act 1979 provides customers with a right to a refund, repair or replacement if an item they purchased

• does not match the description

• is not of satisfactory quality

• is not fit for purpose.

All of our covers are quality control checked before they leave the factory and as such we would not expect any of these circumstances to arise. In the unlikely event that your goods fall into one of the above categories, please contact us and we will make sure that your right to refund, repair or replace is not compromised. If you order from outside the UK, we will not enter into an arrangment whereby you simply decide that the cover is not for you and then return the cover without our permission. We sell thousands of covers all over the world every year and our customer satisfaction ratings are incredibly high. Our product is well crafted and designed and absolutely carries out the purpose for which we portray upon our website content. In the very unlikely event we have manufactured a cover that is not fit for purpose, we would rather you contact us and we may re-send you a cover replacement as anything returned through UK customs will usually take a number of weeks to get back to us and incur a large excise duty. It is usually better for both parties if we first agree the problem and secondly agree a solution. DO NOT under any circumstances send packages back to us without our express permission. If you do choose to send a package back to us and we have not agreed that its unsuitability falls under the three area's of the sales of goods act stipulated above, then we will not take your cover back from UK Customs and the cover will be deemed, undelivered and unpaid and await return to sender at considerable expense to the sender. We do everything in our power to get these orders correct and we operate at 99% customer satisfaction ratings. We have even had testimonials from some customers on our site who were dissatisfied but who chose to follow our returns policy and were delighted with the results. We think this is fair and reasonable and would suggest that you allow us to follow our returns policy in order that we may keep our high customer service ratings.

Under no circumstances should you send your cover back to us without our prior agreement. Our returned goods address will be given to you upon an agreement reached by both parties upon how to best proceed to resolve any disagreement that arises.

4.2 Fast Track 50 and Fast Track 25 orders once placed online, CAN NOT be cancelled. The Fast Track orders operate under an automated process whereby to ensure delivery is made within the timescales purchased, the covers must be cut as soon at the orders are taken. The FT50 (7 day) service, is intended to be delivered within 7 working days and the FT25 delivery within 14 working days, where working days are classed as Monday to Friday. If your order is received on a Saturday or Sunday, it will still be cut over the weekend, but for the purposes of delivery it will be deemed as having been purchased on the next working day, that being the Monday. The timescales we measure ourselves against in order to deliver this service are for 7 and 14 days respectively. By delivery we mean that the date the cover will be dispatched within this 7 or 14 day working period depending upon which service is purchased. Actual physical receiving of the order at your home or stated address may fall outside of the 7 of 14 day period due to location or events beyond our control. In the event that we do not honour our time frames, you will be refunded the extra postage you have paid to receive your cover.

5.0 Delivery of goods to you

5.1 We will deliver the goods ordered by you to the address you give us for delivery at the time you make your order.
5.2 Delivery will be made as soon as possible after your order is accepted. You will be notified of order acceptance.
5.3 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
5.4 Para 3.38 Distrance selling laws: Bespoke goods may not be returned unless faulty. Once covers have been made in a bespoke manner involving any of the following, your own measurements, choice of piping, side and top colour schemes and applied logo, we cannot accept any returns of this nature unless they fall into one or all of the 3 categories specified under the Sales of Goods Act 1979 shown above in section 4.1. If you do feel that you require us to refund, replace or repair goods under this act you must contact us in the first instance and allow us to follow our returns procedure.

6. Fraud prevention
6.1 You agree that we may use Personal information provided by you in order to conduct appropriate anti fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.
6.2 We will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. You can rest assured that this is done only to confirm your identity, that a credit check is not performed and that your credit rating will be unaffected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

8. Events beyond our control
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident . In the unlikely event that our supply of certain materials has become delayed for whatever reason. If there is a delay in manufacture you will be informed of the delay.

9. Governing Law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

10. Entire agreement
These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us and except where you are dealing as a consumer:
10.1 Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us; and,
10.2 Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
11. We accept no liability for covers purchased and shipped outside the UK that are used in direct sunlight for protracted periods of time. Whilst the covers do have a good UV protection factor they are not made to stand in exceptional temperatures in direct sunlight. You are advised that if you do purchase a cover for use outdoors in a tropical or mediterranean climate that you try to place the bike in a shaded environment to preserve the lifetime and fabric of the cover. We also advise you to never place your cover onto a hot exhaust pipe. This warning is also sewn into the inside of your cover and as such is deemed sufficient warning from us in addition to the website collateral to point out that this is not how your cover should be operated.This disclaimer forms part of our contract with you.
